A woman from Mykolaiv was tried for negative comments about Ukrainian soldiers

In Mykolaiv, the Zavodskyi district court found the woman's accusation of making and distributing materials that insult the honor and dignity of a serviceman to be unproven. The prosecutor's office demanded that she should be deprived of her liberty for a period of three to five years.

This is reported by the verdict, which is kept in the Unified State Register of Judgments.

The circumstances of the case

A phone was seized from the woman, in which there was correspondence in the Viber app with negative characteristics addressed to the servicemen of the Armed Forces of Ukraine, who are participating in the war against Russia. In particular, the woman wrote that the Ukrainian military is allegedly setting up positions near residential buildings.

At the court hearing, the woman said that she did not write this. She explained that she had several mobile phones and lent one to friends who did not have money to pay for mobile internet and who were going to evacuate the city and were looking for options of leaving.

According to the accused, offensive messages were sent from her phone by another person. In addition, she did not agree that personal correspondence can be considered the production and distribution of materials with images of military personnel of the Armed Forces of Ukraine.

A Russian flag and three ribbons in the colors of the Russian flag were found during the search of her apartment.

Three witnesses among the neighbors described the accused negatively. It was said that she was a conflicted and pro-Russian person who said that the Russians had come to liberate Ukrainians.

After the water pipe was damaged, the accused prevented the neighbors from collecting water in the yard. The police were called to the scene, and upon their arrival, the accused allegedly had the ringtone of the Russian national anthem playing on her mobile phone. There are numerous lawsuits between her and her neighbors.

What the court decided

As a result, the court found the accusation unproven. It is noted that her posts do not contain specific data of the serviceman.

Other written evidence and testimony of witnesses, in the opinion of the court, do not contain any circumstances to confirm the accusation.

The court ordered to leave the Russian flags seized from the woman in the case file.

It should be reminded that in the Lviv region, a man together with his accomplice transported evaders abroad. He was sentenced to five years in prison, but the judge released the accused from serving the main sentence, setting a three-year probationary period.
